PokeMedia Terms of Service

These Terms of Service (“Terms”) govern the provision of services by PokeMedia (“Service Provider,” “we,” “us”) to clients (“Client,” “you”) who purchase services through Stripe Payment Links or other approved payment methods. By completing a purchase, you agree to these Terms.

1. Term & Renewal

Services are provided on a month-to-month basis. Your subscription will automatically renew each month unless canceled before the next billing cycle.

2. Scope of Services

The specific services provided (including deliverables, posting frequency, or additional features) are determined by the service tier or package you purchase through Stripe.

  • Core services include:

    • Creation of short-form and long-form video content based on your livestreams or provided source material

    • Editing (clipping, captions, effects, and optimization for vertical video)

    • Posting or scheduling content on supported platforms

3. Client Responsibilities

You agree to:
a. Provide timely access to livestreams, videos, or other source material.
b. Provide timestamps or guidance for clipping if required by your package.
c. Grant necessary access to social media accounts or approved posting tools.
d. Respond promptly to communication about approvals, revisions, or scheduling.
e. Ensure that all provided content complies with applicable copyright and intellectual property laws.

4. PokeMedia Responsibilities

We agree to:
a. Deliver services as outlined in your purchased package.
b. Maintain professional editing quality consistent with industry standards.
c. Keep all login credentials and account information confidential.
d. Notify you of any delays, technical issues, or concerns related to your content.

5. Payment

All payments are processed through Stripe. By purchasing a service tier, you agree to recurring monthly charges until cancellation.

  • Payment is due at the time of purchase and renews automatically.

  • Failure to pay may result in suspension of services.

  • All prices are listed in USD unless otherwise stated.

  • Refunds are not provided for partial months or cancellations after a billing cycle begins.

6. Ownership & Rights

  • You retain ownership of your original content.

  • Edited content created by PokeMedia becomes your property upon successful payment.

  • We reserve the right to use completed clips for promotional purposes unless you request otherwise in writing.

  • We may reference your account in outreach or portfolio materials unless you request otherwise.

7. Confidentiality

Both parties agree to maintain the confidentiality of all non-public business, technical, and personal information shared during the course of the services.

8. Termination

Either party may cancel services by providing written notice before the next billing cycle.

  • No refunds will be issued for the current month after services begin.

  • Services end at the conclusion of the current paid cycle.

9. Limitation of Liability

We are not liable for:

  • Algorithm changes on third-party platforms

  • Audience engagement fluctuations

  • Issues caused by external tools, apps, or platforms outside of our control

Our liability is limited to the amount paid for services during the month in which the claim arises.

10. Entire Agreement

These Terms represent the entire agreement between PokeMedia and the Client. They supersede any prior agreements or communications regarding the services.
